How TWC bids

The same three rules govern every number on this sheet.

Scope before price

Every ambiguity goes to the GC in writing before a number is built. Where a quantity cannot be measured, TWC carries a stated allowance and a unit price rather than a guess.

No bid is a real answer

Fifteen scopes were declined this month rather than priced against unresolved risk. Hazardous material is excluded on every proposal until a survey is in hand.

Risk is transferred, not absorbed

Attorney reviewed subcontract with hold harmless, additional insured, primary and non contributory, and waiver of subrogation. No lower tier sub mobilizes without a current certificate on file.

What this pipeline is building toward

The commercial bid book is not the destination. It is how TWC accumulates the past performance required to prime federal set-aside construction.

WHY THE LANE EXISTS

Five percent, and a locked door

The FY2024 NDAA raised the government wide SDVOSB prime contracting goal from three percent to five. In the same act, Congress ended self certification. Only firms certified by SBA now count toward that goal.

At VA the preference is stronger still. Under 38 USC 8127 and 8128, SDVOSBs rank first, ahead of every other small business category. Kingdomware v. United States made the Rule of Two mandatory by unanimous decision. It sits in statute, not regulation.

The mentor protege opening

TWC holds two lifetime SBA protege slots and has used neither. An approved mentor protege joint venture lets an established prime compete for SDVOSB set aside work it cannot bid on its own, with TWC carrying the certification and self performing the interior trades. SBA takes roughly 105 days to approve an agreement, so a fall filing clears in the first quarter of 2027.
